These Terms & Conditions ("Terms") govern your use of the Stay Index website and services (the "Services"), which are provided by Gandhi & Sons LP ("Stay Index," "we," "us"). By using the website, submitting a form, or subscribing to the Services, you agree to these Terms. If you are using the Services for a business, you confirm you are authorized to bind that business. If you do not agree, do not use the Services.
Stay Index provides a customizable digital guest directory for hotels and similar properties, along with related items such as QR codes, QR signs, NFC plaques and Wi-Fi splash page setup. Features, plans and pricing may change over time. Descriptions on this website are for general information and do not create a warranty.
The Services are intended for businesses and adults aged 18 or older. You agree to provide accurate, current information when you contact us or sign up.
Custom QR signs, NFC plaques and other physical items are made to order. Orders are confirmed by us before production. Because items are custom, they are non-refundable and non-returnable unless they arrive defective or materially different from the confirmed order, and you notify us promptly after delivery. Colors and finishes may vary slightly from on-screen previews.
You are responsible for the content you place in your directory, including text, images, logos, offers, prices, hours and advertisements. You represent that you have the right to use that content and that it is accurate, lawful and does not infringe anyone’s rights. You are responsible for complying with all laws that apply to your business, including advertising, consumer protection, pricing, privacy and accessibility laws, and any brand or franchise standards that apply to your property.
If you include advertisements, sponsorships, referral links or promotions from third parties, any agreements, payments, commissions and disputes are solely between you and those third parties. We are not a party to them.
You grant us a limited license to host, display and process your content solely to provide the Services.
You agree not to use the Services to: break the law; post misleading, defamatory, harassing or infringing content; upload malicious code; interfere with or attempt to gain unauthorized access to the Services; or use the Services in a way that could harm us, other customers or hotel guests. We may remove content or suspend access if we reasonably believe these Terms are violated.
The Stay Index website, design, software, text and branding are owned by Gandhi & Sons LP or its licensors and are protected by law. Except for the limited right to use the Services under these Terms, no rights are transferred to you. You keep ownership of your own content and brand assets.
Other companies’ names, logos and trademarks (including hotel brands) belong to their owners. Any reference to them on this website does not imply affiliation with, sponsorship by or endorsement from those companies. The Services rely on third-party providers such as cloud hosting and email delivery, and we are not responsible for outages or acts of those providers.
Revenue estimates, examples and calculators on this website, including the revenue estimator, are illustrative only and are based on numbers the user enters. We do not guarantee any level of revenue, savings, guest engagement or other results.
We aim to keep the Services available but do not promise uninterrupted or error-free operation. We may modify, suspend or discontinue any part of the Services, with reasonable notice where practical.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, GANDHI & SONS LP AND ITS PARTNERS, MEMBERS, EMPLOYEES AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You agree to defend, indemnify and hold harmless Gandhi & Sons LP and its partners, members, employees and affiliates from claims, losses and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Services, your advertising or promotional arrangements, or your violation of these Terms or applicable law.
You may stop using the Services at any time, subject to Section 4. We may suspend or terminate access if you breach these Terms, fail to pay, or if we reasonably believe your use creates risk or harm. Sections that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. We encourage you to contact us first so we can try to resolve any concern informally. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in North Carolina, and you consent to their jurisdiction.
We may update these Terms from time to time. The "Last updated" date shows the latest version. Continued use of the Services after changes means you accept the updated Terms.
